Contribute to the probity of the production entity

Overview

This standard is about checking and confirming that the legal aspects of managing the production is in place. You will contribute to the establishment of the production entity and monitor and control compliance with legal regulations and non-statutory requirements  It is not your responsibility to set the company up, but you are expected to check that these provisions are in place. Registrations that are part of the accounting role include registering with HM Revenue and Customs (HMRC) in relation to taxation.

You are also required to play a role in ensuring that the production stays within any legal or non-statutory requirements both prior to and during each of the production stages such as maintaining the carbon budget. 

 

Performance criteria

You must be able to:

  1. Clarify that the production company is registered with the relevant bodies and can legally trade
  2. Register the production company with statutory bodies relevant to the work of the accounts department to ensure that it operates within legal and statutory requirements
  3. Bring outstanding or unresolved issues relating to the company’s ability to trade legally to the attention of appropriate personnel
  4. Identify any areas of production that may be controlled by legislation or working practices
  5. Provide evidence to support the establishment of credit facilities for an organisation that has not previously traded
  6. Obtain specialist advice where you are unsure whether or not the production is compliant with relevant legislation or codes of practice
  7. Take action to secure compliance and protect the interests of the production where there is a failure to comply with legal and non-statutory requirements

 

Knowledge Criteria

You need to know and understand:

  1. What the legal regulations and relevant codes of practice are and how they apply to the production content
  2. The sources of specialist information and advice that exist and how to access them
  3. What types of materials require permission and the sources for that permission
  4. Who needs to be informed of legal requirements and non-statutory requirements
  5. Why it is important to explain the implications of the requirements for individual responsibility
  6. What actions to take to ensure compliance and when to take them
  7. The different types of communication systems there are and how and when best to apply them
  8. Which accountancy system or package to use
